Maqāṣid Sharia Analysis of PEN Loan Funds for Al-Jabbar Mosque

Abstract. The use of National Economic Recovery (PEN) loan funds for the construction of the Al-Jabbar Grand Mosque in West Java has raised questions regarding its compliance with the principles of maqāṣid sharia, particularly ḥifẓ al-dīn (protection of religion) and ḥifẓ al-māl (protection of wealth). This study aims to analyze the use of PEN loan funds for the mosque’s construction from the perspective of maqāṣid sharia, focusing on ḥifẓ al-dīn, ḥifẓ al-māl, and the balance between maṣlaḥah and mafsadah. This research employed a qualitative method with a normative juridical approach. Primary data were obtained through semi-structured interviews, while secondary data were collected from the Qur’an, hadith, laws and regulations, official government documents, and relevant literature. Data were analyzed descriptively using the maqāṣid sharia framework. The findings indicate that the use of PEN loan funds has legal and sharia legitimacy. From the perspective of ḥifẓ al-dīn, the mosque contributes to religious development but is classified as a taḥsīniyyāt (complementary need) because adequate worship facilities already exist. From the perspective of ḥifẓ al-māl, fund management reflects the principle of amānah, although debt repayment continues until 2029. Overall, the study concludes that the benefits outweigh the potential harms, provided the government fulfills its repayment obligations without compromising the community’s essential needs.
