Legal Protection for a Child Consumers: Bake N Grind Bakery Case

Abstract

Abstract. This research examines the legal protection afforded to a child consumers and the legal liability of Bake N Grind Bakery as a business actor in connection with alleged gluten-free mislabeling of food products, analyzed under Law Number 8 of 1999 concerning Consumer Protection. A child is considered a vulnerable final consumer whose are consumption decisions depend entirely on the product information relied upon by their parents. While developmental terms such as infant or  may describe specific age stages, the term "child" is used in this research to reflect the broader legal status of the consumer under the law. This research uses a qualitative method with a juridical-normative approach and a descriptive-analytical specification, drawing on primary and secondary legal materials that are analyzed descriptively and qualitatively. The results show that Indonesian consumer protection law provides preventive protection through the business actor's obligation to give truthful information, and repressive protection through compensation and dispute-resolution mechanisms. A gluten-free claim is not merely a marketing device but a legal and technical standard — a maximum gluten content of 20 mg/kg — that must be objectively substantiated through laboratory testing. If the alleged mislabeling is proven, the business actor may be held civilly liable through compensation, administratively liable, and potentially criminally liable for trading goods inconsistent with the condition, composition, and promises stated on the label and in promotional materials.
