Abstract

Abstrak. Perjanjian di Indonesia masih mengacu pada ketentuan KUHPerdata yang harus dipenuhi dengan ketentuan Pasal 1320 KUHPerdata. Perjanjian memiliki sifat terbuka, sehingga isi perjanjian itu bisa dilakukan sekehendak kedua belah pihak, bentuk dan isinya. Perjanjian jual beli adalah suatu perjanjian yang dibentuk karena pihak yang satu telah mengikatkan dirinya untuk menyerahkan hak kebendaan dan pihak yang lain bersedia untuk membayar harga yang diperjanjikan sebagaimana Pasal Jual beli menurut ketentuan KUHPerdata Pasal 1457 . Dalam praktik terjadi perjanjian jual beli apartemen, di mana salah satunya mengingkari isi perjanjian tersebut yang selanjutnya disebut dengan Wanprestasi. Adapun tujuan penelitian ini adalah untuk mengetahui Penentuan Wanprestasi Developer Apartemen Newton Residence dihubungkan dengan Buku III Kuhperdata dan Pertimbangan Hakim dalam memutus perkara No. 465/Pdt.G/2020.Pn.Bdg tentang wanprestasi. Kajian penelitian ini menggunakan pendekatan yuridis normative dengan menggunakan spesifikasi penelitian deskriptif analitis, teknik pengumpulan data yang digunakan adalah metode kepustakaan dengan menggunakan data-data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier, serta metode Analisa datanya adalah normative kualitatif. Hasil dari penilitian ini bahwa Penentuan Wanprestasi Developer Apartemen Newton, dihubungkan dengan Buku III KUHPer tidak memenuhi Pasal 1238 mengenai perjanjian yang berdasarkan Perjanjian Pengikatan Jual Beli Satuan Unit Rumah Susun Newton Residence. Di mana dalam hal ini terjadinya wanprestasi mengenai objek perjanjiannya yakni dalam penyerahan 1 Unit Apartemen Newton Residence kepada Pengugat. Hal ini dimaksudkan bahwa agar perjanjian jual beli tersebut sah, haruslah memenuhi Pasal 1320 KUHPerdata, serta pertimbangan hakim dalam memutus perkara ini hanya didasarkan pada ketentuan Pasal 1238 KUHPerdata mengenai wanprestasi terkait PPJB Newton Residence.

Abstract. Agreements in Indonesia still refer to the provisions of the Civil Code which must be met with the provisions of Article 1320 of the Civil Code. The agreement has an open nature so that the contents of the agreement can be carried out at will by both parties, the form, and the content. A sale and purchase agreement is an agreement formed because one party has bound himself to surrender material rights and the other party is willing to pay the agreed price as stated in the Sale and Purchase Article according to the provisions of the Civil Code Article 1457. In practice, an apartment sale and purchase agreement occur, where one of them denies the contents of the agreement, hereinafter referred to as Default. The purpose of this study was to determine the Determination of Default for Developer Newton Residence Apartments related to Book III of the Civil Code and the Judge's Considerations in deciding case No. 465/Pdt.G/2020.Pn.Bdg regarding default. This research study uses a normative juridical approach using descriptive-analytical research specifications, the data collection technique used is the library method using secondary data consisting of primary, secondary, and tertiary legal materials, and the method of data analysis is normative qualitative. The result of this research is that the Determination of Default for Newton Apartment Developers, related to Book III of the Criminal Code does not meet Article 1238 regarding the agreement based on the Sale and Purchase Agreement for Newton Residence Flats. Where in this case the occurrence of default regarding the object of the agreement, namely in the delivery of 1 Newton Residence Apartment Unit to the Plaintiff. This means that for the sale and purchase agreement to be valid, it must comply with Article 1320 of the Civil Code, and the judge's consideration in deciding this case is only based on the provisions of Article 1238 of the Civil Code regarding defaults related to PPJB Newton Residence.
