Pelaksanaan Pemilihan Kepala Desa Berdasarkan Undang-Undang Nomor 6 Tahun 2014 Tentang Desa Dihubungkan dengan Asas Kepastian Hukum (Studi Kasus Desa Luhu)

Abstract. The implementation of village head elections is a citizen's constitutional right to vote and be elected. Matters relating to the election of the Village Head are regulated in Article 31 to Article 39 of Law No. 6 of 2014 concerning Villages. In his government, Luhu Village is led by the Acting Village Head who was ordered by the Regional Government through the SBB Regent's Decree No 141-642 of 2022 to hold Village Head Elections. However, this order has not been implemented and has led to instability in government administration. Therefore the aims of this study are: 1) to find out the implementation of village head elections based on Law Number 6 of 2014 in Luhu Village linked to the Principle of Legal Certainty, and 2) to find out the factors causing the Acting Head of Luhu Village not to carry out village head elections Luhu based on SBB Regent Decree No 141-642 of 2022. This study uses a normative juridical approach, namely a study of the principles related to village head elections, with descriptive analysis research specifications, which describe the authority of the acting village head to organize village head elections based on Law No. 6 of 2014 concerning villages linked to the principle of legal certainty. . Data collection techniques are carried out through library research and field research related to the topic of the problem as material for data analysis. The results of this study are: 1) The Acting Village Head has not complied with the order from the SBB Regent's Decree No 141-642 of 2022 to carry out the holding of Village Head Elections, where this is contrary to the Principle of Legal Certainty as the aim of Village regulation. 2) The factor causing the Village Head election in Luhu Village to not be held was due to differences of opinion between the Luhu Village community groups and also influenced by the lack of legal knowledge about village governance by the Luhu Village community. So that there are no preventive steps taken by the Village Government to synergize the holding of Village Head Elections.

Abstrak. Pelaksanaan pemilihan Kepala Desa merupakan hak konstitusional warga negara untuk memilih dan dipilih. Hal-hal yang berkaitan dengan pemilihan Kepala Desa diatur dalam Pasal 31 sampai dengan Pasal 39 UU No 6 Tahun 2014 Tentang Desa. Dalam pemerintahannya, Desa Luhu dipimpin oleh Penjabat Kepala Desa yang diperintahkan oleh Pemerintah Daerah melalui SK Bupati SBB No 141-642 Tahun 2022 untuk menyelenggarakan Pemilihan Kepala Desa. Namun perintah ini belum dilaksanakan dan menyebabkan adanya instabilitas dalam penyelenggaraan pemerintahan. Maka dari itu tujuan dari penelitian ini yaitu: 1) untuk mengetahui implementasi pemilihan Kepala Desa berdasarkan Undang-Undang Nomor 6 Tahun 2014 di Desa Luhu dihubungkan dengan Asas Kepastian Hukum, dan 2) untuk mengetahui faktor penyebab Penjabat Kepala Desa Luhu tidak melaksanakan pemilihan Kepala Desa Luhu berdasarkan SK Bupati SBB No 141-642 Tahun 2022. Penelitian ini menggunakan metode pendekatan yuridis normatif yaitu kajian terhadap kaidah-kaidah yang berkaitan Pemilihan Kepala Desa, dengan sepesifikasi penelitian diskriptif analisis, yang menggambarkan kewenangan Penjabat Kepala Desa untuk menyelenggarakan pelaksanaan pemilihan Kepala Desa berdasarkan UU No 6 Tahun 2014 Tentang Desa dihubungkan dengan Asas Kepastian Hukum. Teknik pengumpulan data dilakukan melalui studi kepustakaan dan penelitian lapangan yang berkaitan dengan topik permasalahan sebagai bahan analisis data. Hasil dari penelitian ini yaitu: 1) Penjabat Kepala Desa belum memenuhi perintah dari SK Bupati SBB No 141-642 Tahun 2022 untuk melaksanakan penyelenggaraan Pemilihan Kepala Desa, dimana hal tersebut bertentangan dengan Asas Kepastian Hukum sebagai tujuan pengaturan Desa. 2) Faktor penyebab belum terlaksananya pemilihan Kepala Desa di Desa Luhu adalah karena adanya perbedaan pendapat antara golongan masyarakat Desa Luhu dan juga dipengaruhi oleh kurangnya pengetahuan hukum tentang pemerintahan desa oleh masyarakat Desa Luhu. Sehingga tidak adanya langkah-langkah preventif yang dilakukan Pemerintah Desa untuk mensinergikan penyelenggaraan Pemilihan Kepala Desa.
